Apply for Disability in Hawaii
If You Can’t Work Because of Your Health, You Should Consider Applying for SSD
If you can’t work because of health issues and you’re thinking of applying for Social Security Disability benefits, you may not be sure where to begin.
Here are just a few of the things you should know before you consider applying:
- Make sure you won’t be able to work for at least 12 months.
- Make sure you have medical records of any treatment you’re receiving for your illness and/ or injuries.
- Make sure you go to all of your doctors’ appointments.
If you do end up deciding to apply, proving you’re “disabled” to the Social Security Administration (SSA) isn’t easy.
To qualify for Social Security Disability benefits, you must meet the SSA’s definition of “disabled.” The SSA will only deem you disabled if:
- You’re under the age of 50 and can’t work in any capacity;
- You’re over the age of 50 and unable to do lighter work than you’ve done in the past;
- You’re over the age of 55 and unable to do work you’ve done before;
- It’s determined you’re unable to adjust to other work because of your physical and/or mental condition(s); and
- Your disability is expected to last for at least 12 months (or result in death).
Social Security only pays total disability, not partial disability.
Applying for Social Security Disability is a Complicated Process
To qualify for benefits, you must meet the SSA’s definition of “disabled.”
You may think it’s easy to win benefits. You may think it’s as simple as explaining your situation to someone at Social Security. You may think someone will just approve a monthly benefits check for you. In reality, it’s not that easy. It’s even more difficult if you’re under the age of 50. But our attorneys can help.
Most Applications are Denied
There’s nothing more frustrating than receiving a letter saying your claim was denied.
It’s annoying. It’s heartbreaking. And it may feel like the end of the road.
But, there are thousands of rules, regulations and procedures involved in the Social Security Disability program. You can be turned down if a Social Security employee doesn’t collect all of your medical evidence or if your doctor doesn’t understand the definition of disability. You can also be denied if your appeal isn’t handled properly. Fortunately, you can appeal if you’re denied.
